Welcome to Magnolia

These Terms of Service ("Terms") govern your use of Magnolia, a mobile application and related services operated by Vibrantic Ventures ("we," "us," or "our"). By creating an account or using Magnolia, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with these Terms, you may not use Magnolia.

Beta Program Disclaimer

Magnolia is currently in beta. This means:

  • The service is provided for testing and evaluation purposes
  • Features may change, be modified, or removed without prior notice
  • The service may experience interruptions or bugs
  • We may reset data or make changes as needed during the beta period
  • Beta access is by invitation only

By using Magnolia during the beta period, you acknowledge and accept these conditions. We appreciate your feedback in helping us improve the service.

Account Registration

To use Magnolia, you must:

  • Have a valid beta invitation code
  • Provide accurate and complete registration information
  • Be at least 18 years old or have parental consent
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

Acceptable Use

When using Magnolia, you agree to:

  • Upload only your own content - Photos should be of clothing items you own or have permission to photograph
  • Keep it appropriate - Do not upload offensive, harmful, or illegal content
  • Respect others - Do not harass, abuse, or harm other users or our staff
  • Use the service legally - Comply with all applicable laws and regulations
  • Not abuse our systems - Do not attempt to hack, overload, or interfere with our services

You may NOT use Magnolia to:

  • Upload content that infringes on intellectual property rights
  • Distribute malware or harmful code
  • Attempt to access other users' accounts or data
  • Use automated systems to access the service (bots, scrapers, etc.)
  • Resell or commercially exploit the service without permission

User Content & Intellectual Property

Your Content

You retain ownership of all photos and content you upload to Magnolia ("User Content"). By uploading content, you grant us a limited license to:

  • Store, process, and display your content to provide our services
  • Create AI-generated product images from your photos
  • Use anonymized data to improve our AI and services

This license ends when you delete your content or account, except for anonymized data already incorporated into our systems.

Our Content

All features, functionality, design, and content of Magnolia (excluding User Content) are owned by Vibrantic Ventures and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

AI-Generated Content

Magnolia uses artificial intelligence to provide styling recommendations and generate content. Important things to understand:

  • AI is not perfect - Recommendations are suggestions, not professional fashion advice
  • No guarantees - AI-generated images may not perfectly represent your items
  • Use your judgment - Final styling decisions are your responsibility
  • AI may make mistakes - Item detection and categorization may occasionally be inaccurate

Account Termination

By You

You may delete your account at any time through the app (Settings → Account → Delete Account). Upon deletion, your data will be permanently removed within 30 days.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in harmful or abusive behavior
  • Provide false registration information
  • Use the service in ways that harm others or our business

We will provide notice before termination when possible, except in cases of serious violations.

Disclaimers

MAGNOLIA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

  • The service will be uninterrupted or error-free
  • AI recommendations will be accurate or suitable for your needs
  • The service will meet your specific requirements
  • Your data will never be lost (please keep backups of important photos)

Limitation of Liability

To the maximum extent permitted by law, Vibrantic Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Magnolia, including:

  • Loss of data or content
  • Inability to use the service
  • Reliance on AI recommendations
  • Service interruptions or errors

Our total liability for any claims shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Vibrantic Ventures from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of Magnolia
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to the service

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law, including the General Data Protection Regulation (GDPR).

Changes to Terms

We may update these Terms from time to time. When we make significant changes:

  • We will update the "Last updated" date
  • We will notify you through the app
  • Continued use after changes constitutes acceptance of new Terms

If you disagree with updated Terms, you may delete your account.
